Release Wavier

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

THIS FORM MUST BE READ AND SIGNED BEFORE THE PARTICIPANT IS ALLOWED TO TAKE PART IN SPT EVENTS, INC. TRACK EVENT AT SPRING MOUNTAIN MOTORSPORTS RANCH.

IN CONSIDERATION of being permitted to participate in any way in the sport and activities of the “Track Days” at SPRING MOUNTAIN MOTORSPORTS RANCH (“Facility”) sponsored by SPT Events, Inc., the above-named participant (the “Participant”) acknowledges, appreciates, and agrees that:

1. This Release and all other releases required by the Facility shall constitute the entire Release by the Participant.

2. The risk of injury from the activity and equipment of Track Days is significant. The activities of Track Days are very dangerous and involve the risk of serious injury and/or death and/or property damage.  The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of driver’s equipment, vehicular traffic, actions of other people, including, but not limited to organizers, participants, volunteers, spectators, coaches, event officials, and event monitors. These risks are not only inherent to drivers, but are also present for spectators and volunteers.  I hereby assume all of the risks of participating, viewing, and/or volunteering in Track Days.  I realize that liability may arise from negligence or carelessness on the part of the person or entities organizing or conducting Track Days and hereby release them of all possible liability without fault; and

3. I certify that I am physically fit for participation in Track Days and have not been advised otherwise by a qualified medical person.  I acknowledge that this Release and Waiver of Liability form will be used by SPT Events, Inc., to govern my actions and responsibilities at Track Days; and

4. I expressly acknowledge that injuries received by me at Track Days may be compounded or increased by negligent rescue operations or procedures of the Releasees.  While safety equipment and instructions as well as personal discipline will minimize this risk, the risk of serious or fatal injury or disability does exist; and

5. I hereby consent to receive medical treatment, which may be deemed advisable in the event of injury, accident, and/or illnesses during this event.  In which I agree to pay for any and all costs related to medical response, treatment, and transport on my behalf; and

6. I KNOWINGLY AND FREELY ASSUME ALL RISKS, both known and unknown and assume full responsibility for my participation; and

7. I understand that the activities of Track Days are physically and mentally intense.  I understand the rules regarding technical inspection and the general rules of SPRING MOUNTAIN MOTORSPORTS RANCH and will comply with all the rules and regulations.  All facilities are presented “as is.”  SPT Events, Inc. makes no warranty as to the safety of the Participant even if all safety precautions required by the rules are followed.  Compliance with these rules and regulations, as well as proper installation and maintenance of safety devices and appliances, is solely the responsibility of the Participant and absolutely no reliance should be placed on SPT Events, Inc, its directors, officers, employees, volunteers, representatives, and agents to detect any defects, omissions, problems, improper installations, etc. as to any Participant’s vehicle and/or safety devises; and

8. I understand that SPT Events, Inc. has no special knowledge of or expertise in automobile racing or the safety of automobiles used in racing events. While certain vendors may be providing classroom training and in-car instruction on ocular driving by Instructors, SPT Events, Inc. cannot assure me that such instruction and/or training will be adequate for my purposes or sufficient to allow me to safely operate my vehicle on the track(s) of SPRING MOUNTAIN MOTORSPORTS RANCH.  I assume all the risks of taking my vehicle onto the track and/or of my entering into another vehicle on the track.  If I observe any unusual or unnecessary hazard during my participation, I will bring such to the attention of the nearest official as soon as practical; and

9. I certify that I understand the flag system, arm signals, and standard track procedures.  I agree to wear personal protective equipment, including but not limited to an approved helmet.  I certify that my vehicle and all required personal protective equipment is in safe, operational condition suitable for this event.  I agree to abide by the directions/rules given by the organizers of Track Days and understand that my privilege to drive may be removed without refund if I am in violation of the rules set forth or acting/performing in an unsafe manner, or any manner disruptive to the operation of this event; and

10. I, for myself and on behalf of my heirs, assigns, personal representative and next of kin, HEREBY RELEASE AND HOLD HARMLESS FROM ANY CLAIM, ASSERTION, SUIT ACTION OR OTHERWISE, SPT EVENTS, INC., ITS PRINCIPALS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, VOLUNTEERS, OTHER PARTICIPANTS, PROMOTERS, RACING ASSOCATIONS, SANCTIONING ORGANIZATIONS, TRACK OPERATORS, TRACK OWNERS, OFFICIALS, CAR OWNERS, DRIVERS, PIT CREWS, RESCUE PERSONNEL, PREMISE AND EVENT INSPECTORS, SURVEYORS, UNDERWRITERS, CONDULTATNTS, AND OTHERS WHO GIVE RECOMMENDATIONS, DIRECTIONS, OR INSTRUCTIONS OR ENGAGE IN RISK EVALUATION OR LOSS CONTROL ACTIVITIES REGARDING THE PREMISES OR TRACK DAYS AND THE OWNERS OF SPRING MOUNTAIN MOTORSPORTS RANCH, THEIR RESPECTIVE PERSONAL REPRESENTATIVE, HEIRS, ASSIGNS AND OTHERS (“RELEASEES”) WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, LOSS OR DAMAGE TO PERSON OR PROPERTY, INCLUDING DEATH OF THE UNDERSIGNED, PROPERTY THEFT, OR ACTIONS OF ANY KIND WHICH MAY HEREAFTER ACCRUE TO PARTICIPANT OR PARTICIPANT’S TRAVELING TO AND FROM THIS EVENT, INCLUDING ATTORNEY’S FEES AND DEFENSE COSTS, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE; and

11. I acknowledge that I am not required to participate in Track Days and do so voluntarily for my personal pleasure and that I have not been induced into signing this Release.  I understand that I can refuse to sign this Release and not participate in Track Days; and

12. I represent and warrant that I am over the age of eighteen (18) years of age and am competent to execute this Release; and

13. This Release shall be governed, enforced, performed and construed in accordance with the laws of the State of Maryland, without reference to principles of conflicts of law.  If any dispute or controversy arises among the parties to this Release or concerning any provision of this Release, the Party which does not prevail in such proceedings shall pay the reasonable attorneys' fees and other costs and expenses incurred by the prevailing party.  Each of the parties consents to the exclusive jurisdiction of the courts of the State of Maryland; and

14. Each provision of this Release shall be considered separable and if for any reason any provision or provisions in this Release are determined to be invalid or contrary to any existing or future law, that invalidity shall not impair the operation of this Release or affect those portions of this Release which are valid; and

15. This Release may be amended only in a writing signed by the Parties to this Release.

I, THE UNDERSIGNED, HAVE READ THIS RELEASE OF LIABILITY AND ASSUMTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

Please read the ENTIRE Release Wavier before you agree to it. A hard copy will also be signed upon check in at the time of the event.
